Terms and Conditions

Welcome to Time Out Rent A Car. By using our services, you agree to comply with these Terms and Conditions. Please read them carefully before booking.

1. Definitions

  • “We,” “Us,” “Our” refers to Time Out Rent A Car.
  • “You,” “Your” refers to the customer renting a vehicle.
  • “Vehicle” refers to any car rented from Time Out Rent A Car.

2. Eligibility

  • Renters must:
    • Be at least 19 years old.
    • Hold a valid UAE driving license or an international driving permit (if required by UAE law).
    • Provide valid identification, such as a passport or Emirates ID.
  • We reserve the right to refuse service to individuals who fail to meet these requirements.

3. Rental Bookings

  • Advance Booking: All rentals must be booked in advance.
  • Confirmation: Bookings are confirmed only after payment of the non-refundable booking fee.
  • Vehicle Availability: While we strive to meet your preferences, specific vehicles are subject to availability. In case your preferred vehicle is unavailable, a suitable alternative may be provided.

4. Payment Terms

  • Payment must be made in full before the rental period begins unless agreed otherwise in writing.
  • Accepted Payment Methods: Credit/debit cards, Crypto, and Cash.
  • Late Payments: Any overdue payments will incur a penalty of 50 per day.

5. Security Deposit

  • A refundable security deposit is required before the rental begins.
  • The deposit will be refunded within 15 days after the vehicle is returned, provided:
    • There is no damage to the vehicle.
    • There are no outstanding fines or unpaid dues.

6. Use of Vehicle

You agree to:

  • Operate the vehicle responsibly and in compliance with all UAE traffic laws.
  • Return the vehicle in the same condition as received.
  • Refill the fuel tank to the agreed level before returning the vehicle.

Prohibited uses include:

  • Allowing unauthorized individuals to drive the vehicle.
  • Using the vehicle for racing, towing, in the desert or any illegal activity
  • Smoking or consuming illegal substances in the vehicle.

Failure to comply may result in additional charges or termination of the rental agreement.

7. Mileage and Fuel Policy

  • Vehicles come with a mileage of 250km limit per day . Excess mileage will incur additional charges depending on the vehicles category.
  • Vehicles must be returned with the same fuel level as when rented. If not, refueling charges will apply.

8. Liability and Insurance

  • All vehicles are insured as per UAE regulations.

Optional Collision Damage Waiver (CDW) Plans

We offer optional CDW plans to reduce your financial liability in the event of an accident to the vehicle:

  1. Standard CDW:

    • Reduces your liability for damages to the vehicle to AED 3,000
    • Cost: AED 100/day

  2. Premium CDW:

    • Reduces your liability for damages to the vehicle to AED 2,000
    • Cost: AED 200/day

  3. Exclusive CDW (Expensive Plan):

    • Reduces your liability for damages to zero (0), meaning you will not pay any repair costs in the event of an accident.
    • Includes free roadside assistance and priority vehicle replacement.
    • Cost: AED 400/day

Important Notes:

  • CDW does not cover damage caused by negligence, misuse, or violation of traffic laws.
  • CDW DOES NOT COVER damage if the vehicle was driven by unauthorized driver or by authorized driver under the influence of alcohol or drugs, damage to the interior of the vehicle, tire and wheel damage, windscreen, wheel cover and rims, damage to the underside of the vehicle, broken or lost key, lost or damage car documents, contamination of fuel, either in the event of deliberate intention or negligence.
  • A valid police report must be provided for CDW coverage to apply.

9. Late Returns and Extensions

  • Vehicles returned after the agreed rental period will incur late charges fees.
  • If you wish to extend the rental period, notify us in advance. Extensions are subject to approval and additional fees.

10. Cancellation and Refund Policy

  • Non-refundable Booking Fee: This fee is not refundable under any circumstances.
  • Refunds for early returns are not provided.

11. Traffic Fines and Violations

  • You are fully responsible for any traffic fines, parking tickets, or violations incurred during the rental period.
  • If unpaid fines are passed on to us, an administrative fee of 50 AED will apply.

12. Data Sharing and Privacy

We may share your data with:

  • Sister companies for seamless operations and service enhancements.
  • Third-party service providers for IT, blacklist management, or debt collection.
  • Legal authorities as required by UAE law.

13. Termination of Agreement

We reserve the right to terminate the rental agreement immediately if:

  • You breach any of these terms and conditions.
  • The vehicle is used for unauthorized or illegal purposes.
  • Payment is not made as agreed.

In such cases, the vehicle must be returned immediately, and no refunds will be issued.

14. Indemnification and Disclaimer of Liability

You agree to indemnify, defend, and hold Time Out Rent A Car, its affiliates, employees, officers, agents, and partners harmless against any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from or related to:

  1. Your misuse of the vehicle:

    • Including, but not limited to, reckless driving, overloading, improper maintenance, and unauthorized alterations or repairs.

  2. Breaches of these Terms and Conditions:

    • Any failure to comply with the obligations outlined in this agreement, such as unauthorized use of the vehicle, violations of traffic laws, or failure to return the vehicle on time or in acceptable condition.

  3. Third-party claims:

    • Any claims or disputes arising from accidents, injuries, damages, or losses caused directly or indirectly by your actions while operating the rented vehicle.

  4. Traffic violations and penalties:

    • Including but not limited to fines, penalties, towing charges, or legal expenses resulting from your failure to adhere to UAE traffic laws.

  5. Damage to third-party property:

    • Any physical damage, injury, or financial loss incurred by a third party as a result of your use of the vehicle.

  6. Negligence or intentional misconduct:

    • Any damage or liability resulting from your deliberate or grossly negligent acts, including but not limited to:
      • Drunk driving.
      • Driving under the influence of drugs or other substances.
      • Using the vehicle for illegal or prohibited purposes.

  7. Unauthorized drivers or activities:

    • Any damage or liability caused by individuals driving the vehicle who are not listed as authorized drivers under the rental agreement.

  8. Insurance coverage disputes:

    • Any liability arising from your failure to obtain or comply with insurance or CDW terms, including providing valid police reports or following accident procedures.

Disclaimer of Liability for Harm or Death

Time Out Rent A Car assumes no liability for any injury, harm, or death that may occur during the use of the rented vehicle, whether caused by:

  • Your own negligence or actions.
  • Mechanical issues not reported or addressed in a timely manner.
  • Traffic accidents or other incidents involving third parties.

By renting a vehicle from us, you acknowledge that the use of a motor vehicle inherently carries risks, and you accept full responsibility for your own safety and the safety of your passengers.

This indemnification and disclaimer of liability obligation will survive the termination of the rental agreement and extend beyond the rental period.

15. Governing Law

These Terms and Conditions are governed by the laws of the United Arab Emirates. Any disputes will be resolved under the exclusive jurisdiction of the courts of Dubai.

16. Changes to Terms and Conditions

We reserve the right to update these Terms and Conditions at any time. Any changes will be posted on our website with the revised effective date.
